While prior to 9/11, having reached a certain degree of consensus on impermissible conduct irrespective of its specific designation, the emphasis was on the distinct features of different forms of inhumane treatment, the post-9/11 era blurred the boundary between permissible and impermissible conduct. This was made possible by a series of converging developments that privileged the maintenance of security and, in the process, created a perfect storm for the protection of persons.
